Applicable to anyone using the application, in particular the shops’ customers.

1. Purpose

These terms of use set out the conditions for accessing and using the Emelva service, a virtual fitting room that lets you try on pieces from partner shops on your own silhouette, starting from a photo.

2. Access to the service

The service is accessible from a web browser, with no application to install, via the QR code or the link provided by a partner shop. Access requires an internet connection and a compatible device.

3. Use of the photo and the silhouette

To work, the service asks the customer to provide a full-length photo. That photo is processed to generate a reusable fitting silhouette, which stays private and is never published. The detailed arrangements are set out in the Privacy policy.

4. User undertakings

The customer undertakes to use the service for its intended purpose and not to:

  • provide a photo of another person without their consent;
  • attempt to disrupt, circumvent or misuse the operation of the service;
  • use the service for unlawful purposes or in breach of third-party rights.

5. Intellectual property

Collection imagery remains the property of the shops. The generated silhouette is intended for the customer’s personal and private use. The Emelva trade mark, logo and interface are protected and may not be reproduced without authorisation.

6. Liability

A virtual try-on is a simulation provided for guidance only; it cannot constitute an exact guarantee of size, fit or colour. The purchase decision and the real fitting are matters for the shop.

7. Personal data

Data processing is described in the Privacy policy and the Cookie policy. The customer may delete her photo and her silhouette at any time.

8. Term, amendment and termination

These terms apply for as long as the service is used. The publisher may amend them at any time; the applicable version is the one in force at the time of use. The customer may stop using the service and delete her data whenever she wishes.

9. Governing law

These terms are governed by French law. Any dispute falls, failing an amicable resolution, within the jurisdiction of the competent courts.
